Loan Applications

Loan applications submitted through our website brenance.com are not to be construed as a commitment to lend money or a commitment to borrow.  Brenance, LLC and its affiliates will conduct customary due diligence with respect to the Borrower, any proposed guarantors, and the property proposed as security to the loan.  By applying for a loan, the borrower authorizes such investigations, which may include but are not limited to credit reports and background checks on any proposed guarantors, principals, and affiliated entities, and an appraisal of the property proposed to secure the loan.  This proposal does not contain all of the specific terms and conditions that may be included in the final loan documents if a loan is approved and does not include all costs associated with the loan, including but not limited to inspection fees, draw fees, wire fees, late fees, and other fees.  The final terms of any loan, conditions to closing, timing of transaction closing, and actual funding shall be at the sole discretion of Brenance, LLC and its affiliates.  For construction loans, budget overages or upgrades will be the responsibility of the Borrower.  If a loan contains an interest reserve account, that account will be used to make required monthly payments on the loan until the reserve account is depleted, at which time the Borrower is required to make up any deficiency and payments as required by the loan agreement.  All third-party expenses incurred by Brenance, LLC after the acceptance of this pricing estimate by the Borrower are the responsibility of the Borrower, whether or not Brenance, LLC agrees to make the loan.  Acceptance of a pricing estimate (LOI) does not commit you to a loan.

Project Analysis

Loan analysis and projection estimates provided by Brenance LLC are based on budget figures, development schedules, expected sales prices, selling forecasts, and other supporting documents provided directly by the investor/builder/sponsor. Projections, analyses, and reports provided by Brenance are generally based on the supporting documents provided by the investor/builder/sponsor and are used internally to evaluate the suitability of the financing structure and potential risks that may be present. Maximum loan amounts determined by loan-to-value (LTV) and loan-to-cost (LTC) limiters, loan terms, note interest rates, interest reserves, financing costs, and transaction costs are only estimates based on current lending criteria at the date of final review and may be subject to factors and limitations of 3rd parties such as capital markets, note buyers, appraisal reports, budget reviews, and feasibility reports. All submitted loans are subject to change until final loan approval. A reduction in leverage, budget overages, or a cost of capital increase may negatively affect the loan's estimated equity requirement and require additional contributions.
